Excluded data and assets
The export does not include the Mobile Joe software including its source code, Bytekontor's internal infrastructure configurations and service-wide security rules, or credentials and authentication secrets. Data on internal functioning is covered by this exclusion only where there is a risk of breaching trade secrets and the exclusion does not impede or delay switching. Customer-related configurations and log data are not excluded merely because they serve operational or security purposes.
Switching information
The export register describes the retrieval procedure, data structures, data formats and relevant standards and open interoperability specifications.
Known limitations
The export transfers data and digital assets usable by the Customer. It does not include the Mobile Joe software or any commitment that a destination provider offers the same features or can import the exported data without adaptation.
International access
Infrastructure jurisdiction
The infrastructure providers used, their services and the respective processing locations are listed in the current Subprocessor List. This list is the authoritative source for provider and location information and forms part of this transparency information.
Infrastructure in Germany or another Member State is subject to the law of the European Union and of the respective Member State. Providers based in the USA may also be subject to US law. For globally provided network services, the legal systems of the respective processing locations may also be relevant.
Safeguards
To protect non-personal data stored in the Union against unlawful governmental access from third countries, Bytekontor uses data minimisation, regional processing, encrypted transmission, role-based permissions and contractual obligations of the providers used. Bytekontor reviews governmental access requests for jurisdiction, legal basis and scope and, where legally permissible and necessary, rejects or challenges them. Bytekontor informs Customers where legally permissible.
